The New York State Office of Parks, Recreation and Historic Preservation (OPRHP) uses, with permission, user-generated content on its social media channels, website, blog, publication and other promotional materials. Content may be submitted either via email to notes@parks.ny.gov or stories@parks.ny.gov, by upload via a third-party app, or by direct upload on our homepage, or via reply to an OPRHP request for permission through social media with the hashtag #YesParks.
By submitting your content to OPRHP, you agree to the following terms and conditions:
1. By submitting your text, photograph or video ("Content"), you grant the New York State Office of Parks, Recreation and Historic Preservation, its officers and employees, and any authorized agents, affiliates or subsidiaries (collectively, "OPRHP"), a royalty-free, perpetual, non-exclusive license to use, reproduce, modify, publish, edit, transfer, distribute, display, create derivative works based on and otherwise use the submitted Content, in whole or in part, for advertising and promotional purposes and for any other purpose (including, without limitation, posting or publishing the submitted Content on or in OPRHP's website, blog, promotional materials and social media channels) worldwide, in all media and formats whether now or later known or developed, without further notice or compensation. You further grant ORPHP the right to use your name and likeness as embodied in the Content.
2. You represent and warrant that (1) you are least eighteen (18) years of age and have the right and authority to post and license the submitted Content; (2) the use of the submitted Content by OPRHP will not infringe upon or violate the intellectual property or other rights of any other person or entity or otherwise subject OPRHP to any royalty or other payment obligation to any third party; and (3) if submitted via reply, the submitted Content conforms to the Terms of Service of the applicable social media platform. If your Content contains the name or likeness of anyone other than yourself, you further represent and warrant that you have obtained their permission to submit the Content and for their name and likeness to be used by OPRHP in the manner described above.
3. You understand that use of submitted Content is solely at the discretion of OPRHP, and that OPRHP is not obligated to use submitted Content.
4. OPRHP can remove Content from its social media channels, website and blog at the request of the submitter. However, OPRHP is unable to remove Content from other any other publications and/or promotional materials. To request removal from OPRHP's social media channels, website or blog of Content you submitted, contact notes@parks.ny.gov or call 518-486-1868 identifying the submitted Content, yourself and the method of submission.
